Terms of Contract

You will need to complete the form at the bottom of this page, in order for us to start any repairs or servicing for you.

Terms of Contract for SMS Electronics

1. Introduction
1.1 These terms and conditions ("Terms") govern the relationship between SMS Electronics Ltd ("we," "us," or "our") and the customer ("you" or "your") for all electronics repair services ("Services") provided by us.

1.2 By submitting a request for repair or any related service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not proceed with the request.

 

2. Service Agreement
2.1 Once a repair request is accepted, a service agreement is formed, binding both parties to the obligations outlined in these Terms.

2.2 The service will be performed at the location and time agreed upon during the consultation and as per the specifications agreed in writing or via email.

 

3. Payment and Pricing
3.1 A quotation for the repair services will be provided prior to work commencing. Any alterations to the quoted price must be agreed upon in writing and will be charged accordingly.

3.2 Payment for completed services is due upon completion of the repair, unless otherwise agreed. We reserve the right to charge interest at the rate of [5]% per month on any overdue amounts.

 

4. Cancellation and Termination
4.1 Cancellation by the Customer:
You may cancel the repair services at any time before the work commences. In the event of cancellation after work has commenced or parts have been ordered, the customer agrees to cover any costs already incurred by SMS Electronics, including but not limited to labour, purchased parts, and accessories.

4.2 Cancellation Fee:
If you cancel the repair service once work has started or parts have been purchased, a cancellation fee may apply, which will include any labour costs up to that point, costs for any parts ordered, and a £10 administration fee. The cancellation fee will be invoiced and is due immediately.

4.3 Non-Completion by Customer:
If you refuse to proceed with the repair after the work has started or once parts have been purchased, you will be liable for all incurred costs, including but not limited to:

  • Labour already spent on the repair.

  • Parts and accessories purchased in anticipation of the repair, which may not be returnable or refundable.

  • Any additional costs incurred directly related to the repair, including shipping or handling fees.

4.4 Loss of Earnings:
In the event that a customer cancels during or immediately prior to the work, you agree to cover the potential loss of earnings for SMS Electronics. The loss of earnings will be calculated based on the time reserved for your repair, and the business could potentially have serviced other clients during that time.

 

5. Parts and Accessories
5.1 We will notify you of any necessary parts or accessories needed for the repair. In cases where parts need to be purchased in advance, we will inform you of the cost and obtain your consent before proceeding with any purchase.

5.2 Once parts have been purchased, you are liable for the cost of the parts, even if you decide to cancel or refuse to proceed with the repair. You agree to pay for any non-returnable or non-refundable parts or accessories purchased.

 

6. Warranty and Guarantee
6.1 We do not provide a warranty on the labour performed for repairs, except where legal obligations apply, such as the consumer Rights Act 2015. This covers only the specific repair performed and does not extend to parts or components not replaced or repaired by SMS Electronics.

 

7. Liability and Limitations
7.1 SMS Electronics will make every effort to ensure that repairs are carried out professionally and correctly. However, we are not responsible for pre-existing faults, damage caused by external factors (such as electrical surges, water damage, or improper handling), or any damages that may occur after the repair.

7.2 SMS Electronics is not liable for loss or damage to data stored on any devices being repaired. It is the customer’s responsibility to ensure that all important data is backed up before repairs commence.

 

8. Data Collection and Protection
8.1 Customer Information:
By agreeing to these Terms, you consent to provide your personal details to SMS Electronics. The required details include your full name, address, phone number, and email address, which are necessary for us to process the repair request and provide our services.

8.2 Contact Form and Consent:
You are required to fill out the contact form, providing the necessary personal details, and check the box and signature indicating that you agree to our Terms and Conditions. This form will be completed before any repair work commences. Your information will be stored securely on our internal database.

8.3 Data Protection:
SMS Electronics is committed to protecting your personal data. We will only use the personal data you provide for the purposes of completing the requested repair and for contacting you regarding your service. Your data will be handled in compliance with the Data Protection Act 2018 and the General Data Protection Regulation (GDPR).

8.4 Data Storage and Access:
Your personal details will be stored securely on our internal database and only accessible to authorized personnel. We will not share your personal data with third parties unless required by law or for the purpose of the repair service (e.g., to order parts from a supplier).

8.5 Your Rights:

9. Disputes and Legal Action
9.1 In the event of a dispute, we will make every effort to resolve the matter amicably through direct communication. If a dispute cannot be resolved informally, either party may seek resolution through mediation or, if necessary, legal action.

9.2 These Terms shall be governed by and construed in accordance with the laws of England and Wales.

 

10. Force Majeure
10.1 SMS Electronics shall not be held liable for any delay or failure to perform its obligations under these Terms caused by circumstances beyond its reasonable control, including but not limited to acts of God, governmental actions, strikes, lockouts, or failure of suppliers or subcontractors.

 

11. Amendments
11.1 SMS Electronics reserves the right to amend or update these Terms at any time. Any changes will be communicated to the customer in writing and will apply to services rendered after the date of the amendment.

Before we are able to start any work, you will need to read the terms of contract, as above, and fill out the requested details below, to confirm that you are happy to proceed with the terms, and that you are happy to pay and complete all and any relevant payments fees for the service, including parts, labour, third-party fees, and any other fee, such as cancellations charges.
